Terms of Use

General

By registering for this program you certify under penalty of perjury that you will be taking the course without any outside help. You will abide by all terms of the contract and will not knowingly accept a course completion certificate if the course has not been completed. New York Safety Program retains the right to monitor your participation and cancel your enrollment contract if we believe someone other than the enrolled student has been participating in the course. You will not be eligible for a refund. It is illegal to attempt to circumvent this course or provide false information.

Certificate of Completion Policy

New York Safety Program will submit your certificate to the DMV electronically and to you by mail. One free hard copy of the course completion certificate is mailed to the student's address provided on the enrollment contract. A $10 fee will apply for any corrections and duplicate certificate requests.

Once the DMV receives your certificate, New York Safety Program has no control over how quickly they processes your certificate. It is the student's responsibility to follow up with them.

I. Electronically
New York Safety Program will submit your certificate electronically to DMV.

II. By Mail
Unless otherwise requested by the student, completion certificates are mailed via regular First Class Mail through the USPS. Delivery time is estimated at 1-5 business days but not guaranteed. Express and tracking delivery options are available for an additional fee. Students are given the option to choose the shipping method before taking the final exam or by calling us at 888.292.0397. If you are pressed for time, it is recommended that you choose a shipping method that offers tracking or delivery confirmation.

Same day certificate processing is valid when you complete the course by 2pm (PST) on regular business days Monday through Friday excluding holidays. If you complete the course after 2pm (PST) or on a weekend or holiday, your certificate will be mailed the following business day. To ensure you receive your certificate on time, we recommend completing the course at least 10 days prior to your due date.

New York Safety Program is not responsible for certificates delayed or lost by the USPS, FedEx, the state, or the court. Shipping problems with USPS or FedEx must be directed to that company's customer service department.

Please Note: All shipments are sent with "no signature required" from Van Nuys, California 91411. Rates are based on addresses within the continental US. FedEx services are available and guaranteed for most areas. Certain FedEx services cannot be guaranteed for rural or remote areas. Please consult the FedEx website to determine availability and delivery times for your area. FedEx cannot deliver to Post Office boxes.

FedEx 2Day With Tracking $21.00
Delivery by 4:30pm (residential by 7:00 pm) in 2 business days from the day it was sent (Monday through Friday excluding holidays).

FedEx Priority Overnight With Tracking $31.00
Delivery by 10:30am to most areas the next business day (Monday through Friday excluding holidays).

FedEx Overnight Saturday Delivery With Tracking $44.00
Delivery by 1:30 pm to most areas on Saturday.

Student Identity Verification

All Internet Point and Insurance Reduction Programs including New York Safety Program, are required by law to provide a 3-step student identity verification.

Phone Contact with Caller ID

When you first login to the course, you will be required to provide a U.S. telephone number. Then during the course, you will be randomly prompted to verify your understanding of the course content by answering an online driving knowledge question, verify your phone number, and then confirm your participation by simply entering a PIN, which will be provided by us at that time. The PIN can either be sent to you via text message or as a telephone call. If you choose to recieve the PIN via text message you understand and agree to recieve a text message for each verification prompt. You will not revieve any additional text messages from us after you complete the courtse or cancel the course. Depending on your cellualr phone plane message and data rates may apply.

Payment and Refund Policy

I. Payment Information
We request financial information (credit or debit card) from the customer through our electronic payment submission form. This information is used for billing purposes only. Credit card numbers are stored securely and accessible only to authorized New York Safety Program management.

II. Refund Policy / 100% Money Back Guarantee
New York Safety Program agrees to grant a full refund to any student that cancels the enrollment contract before completing the course. All refunds will be credited in the same form as the original payment type and will be completed within 30 days after the effective date of enrollment termination. Any student that has completed the course, has willfully misrepresented himself or has cheated is ineligible for a refund.

Any student who has not successfully completed the course within 180 days from enrollment date and time will be terminated without notice and will not be eligible for a refund or credit towards a new course.

III. Start Now Pay Later
The Start Now Pay Later option allows students to view a portion of the course at no charge. After the trial portion of the course is complete, students who choose to continue with the course must submit payment in full.

Email Communications

New York Safety Program communicates with students primarily via email. Many of these emails are automatically generated including confirmation of registration, confirmation of completion, and confirmation of cancellation. If no email address is provided, the student will not receive these confirmations. New York Safety Program also contacts students first via email regarding problems that need the student's attention. If no email address is provided, the student is contacted via the telephone number provided at registration.

Occasionally New York Safety Program may email you special discount offers. To discontinue receiving these emails simply follow the opt-out link within the email.

To ensure that you receive New York Safety Program emails, it is important that you put New York Safety Program on your e-mail's "safe" or "white" list. Not doing so may cause these emails to be placed in your junk folder or deleted by your email program. New York Safety Program is not responsible for any loss that may occur as a result of deleted or lost email communications.

Minimum Technology Requirements

The New York Safety Program course will work with both PC and Mac computers and with any major web browser. In addition, the browser needs to support JavaScript, cookies, and sessions. An Internet connection with a dial up modem of 28.8 bps or any high speed connection is also needed to connect to the course.

New York Safety Program is not responsible for Internet connectivity issues that may arise while the student is taking the course.

Limitations of Liability

The information provided within the course is accurate to the best of our knowledge. However, no guarantee of suitability for any purpose is offered or implied. No responsibility is assumed by New York Safety Program for any use, or for any consequences resulting from any use of the information.

Student Responsibilities

It is the student's responsibility to:

Make sure they are eligible to take the New York Safety Program course for their chosen state or court,
Provide accurate personal information during registration,
Study the course material and complete the course without any outside help,
Complete the course within the time allotted by the DMV, court or other state agency,
Follow up with the DMV, court or other state agency to ensure the certificate was received and the case was cleared.

Dispute Policy

By registering for the New York Safety Program you agree to submit any dispute arising under this agreement, except a dispute alleging criminal violations or seeking punitive damages or damages for mental anguish, to arbitration in accordance with the rules of the Better Business Bureau (Binding). A volunteer arbitrator will render a decision based upon fairness, not necessarily upon legal principals, but it will be final and binding on both parties. Judgment on the decision may be entered in any court having jurisdiction. You will not have to pay anything for arbitration.

This agreement to arbitrate affects important legal rights. Neither you nor New York Safety Program will be able to go to court for a dispute once there is an agreement to arbitrate.
